The aim of this study consists of postulating an ethical approach to Human Rights conceiving them as rights of the other, claiming that this approach represent a starting point for the development of a legal pluralism that contributes to the achievement of an effective and authentic peace. For this study is based on the premise that the law must be able to deal with the serious and still pending social and environmental problems that underlie the violations of human rights, especially (...) those of ecological nature. By way of conclusion, the need for a radical change of the paradigm is evidenced, for which a perspective of ethics as a linguistic praxis is proposed, since such praxis has the potential to inspire the reformulation of human rights, for the purpose of reversing the dynamics of violence imposed by the logic of identity underlying the current legal system. IntroductionPreoperative neurocognitive disorder is a common condition affecting 14–51. 7% of the elderly population. General anesthesia has already been associated with the one-year post-operative neurocognitive disorder, specifically, a deficit in executive function, measured by the Trail Making Test B, but its long-term effects on cognitive function have not been investigated. We aimed to detect preO-NCD prevalence in patients scheduled for cardiac surgery and further investigate the possible role of previous general anesthesia in general preoperative cognitive status [measured via the Montreal (...) Cognitive Assessment ] and/or in executive functioning.MethodsIn this observational, prospective study, 151 adult patients scheduled for elective cardiac surgery underwent MoCA and TMT-B. Data on age, education, pGA, comorbidities, and laboratory results were collected.ResultsWe discovered a general cognitive function impairment of 79.5% and an executive function impairment of 22%. Aging is associated with an increased likelihood and education with a decreased likelihood of general cognitive impairment, but only education was significantly associated with a decreased likelihood of executive function impairment. While pGA did not significantly affect preO-NCD, a noteworthy interaction between aging and pGA was found, resulting in a synergistic effect, increasing the likelihood of executive function impairment.ConclusionWe found a high prevalence of preO-NCD in patients scheduled for cardiac surgery. General cognitive function impairment is highly associated with advancing age. However, older patients with at least one pGA appeared to be at an increased risk of preO-NCD, especially executive function impairment, suggesting that TMT-B should be associated with MoCA in the preoperative cognitive evaluation in this population. En este complejo futuro que se nos predice, no solo se nos podrá superar en nuestras capacidades intelectuales o físicas, incorporando a nuestro entorno y a nuestro propio cuerpo un ingente aparataje tecnológico, sino que se nos podrá mejorar, y ello, incluso, antes de nacer, interviniendo directamente sobre el embrión. La naturaleza de lo humano se pone en cuestión, sobre todo, cuando la alteramos en su propia esencia, no solo en su entorno, y, además, desde su propio inicio. Se trata, (...) pues, de una disrupción y alteración sustancial ad intra del ser humano, no ad extra, como ocurre con la tecnología, aún cuando esta también tiene, obviamente, muchos efectos en el interior de aquél. Los cambios que se derivan de la Biotecnología y, concretamente, de la edición genómica, por un lado, ofrecen un enorme potencial para desarrollar nuevos conceptos, métodos y novedosas aplicaciones para los urgentes retos y necesidades de la sociedad. Por el otro lado, tales biotecnologías son percibidas como si tuvieran el potencial de desafiar y, a veces, desdibujar las actitudes, valores y modelos culturales de la propia sociedad. A tal reto no puede estar, obviamente, ajeno el Derecho en atención a los valores, intereses y derechos en conflicto. Si la pregunta que debemos nuevamente formularnos es qué es el hombre o qué es la naturaleza humana, el Derecho debe también ofrecer respuestas que permitan dar un sentido jurídico contemporáneo a tal esencia, preguntas que conectan directamente con el propio concepto jurídico de dignidad, no solo en cuanto valor ontológico del ser humano, sino también, recogiendo los términos explícitos del artículo 10.1 de nuestra Constitución, en cuanto fundamento del orden político y de la paz social. This study investigates how e-business capabilities and digital marketing strategies jointly influence business performance in the e-commerce industry, which has experienced unprecedented growth driven by technological advancements and changing consumer behavior. E-business capabilities encompass the use of technology and digital infrastructure, while digital marketing strategies are employed to attract and retain online customers. The study examines the effect of e-business capabilities through digital marketing strategies on the customer satisfaction and loyalty of UAE e-commerce industry. The research is descriptive and explanatory, (...) and uses a structured 5-scale Likert questionnaire to collect data from the HR managers of 135 e-commerce companies based in UAE. The statistical analysis is performed using structural equation modeling. The findings highlight the significant relationship of the study variables. Consequently, the results of this study provide valuable insights for e-commerce businesses, elucidating the need to invest in robust e-business capabilities to support effective digital marketing efforts. Additionally, the research underscores the significance of tailoring digital marketing strategies to align with specific business objectives and customer segments. The study also contributes to the literature on digital transformation, by demonstrating how e-business capabilities and digital marketing strategies can enable e-commerce firms to adapt and thrive in the dynamic and competitive digital environment. En plus de concevoir la vue et la pensée comme des processus empiriques capables de reproduire les caractéristiques des corps, Épicure reconnaît un processus psychophysique intermédiaire par le biais duquel les phantasiai ou représentations sont produites dans l’esprit et synthétisent les caractéristiques des objets sensibles. L’objectif de cet article est de monter qu’Épicure a retravaillé la doctrine de Démocrite dans cette direction, à la lumière de la critique aristotélicienne de certaines théories de la perception et de sa réflexion sur la (...) formation du phantasma. Nous étudions le processus physiologique à l’origine de la phantasia chez Épicure, et nous montrons son lien avec le processus psychophysique adopté par Aristote pour expliquer la représentation. Current research on construction of the female body focuses on non-Hispanic women in the United States. The idealized Latina body, however, is rapidly becoming commodified and objectified in global popular culture. Using standardized and open-ended surveys and group and individual interviews, the author examines the negotiation of sociocultural ideals and body image by adolescents at the intersection of gender, race, and beauty. These young women hold racist beauty ideals but are flexible when judging the appearance of real-life women. They perceive (...) two competing or complementary prototypes of beauty, one white and one Latina. This study fills a gap in the literature on beauty and the body by examining a non-U.S. sample that does not fit into the usual Black-white dichotomy of race. (shrink)

Este trabajo busca responder al siguiente interrogante: ¿es posible resolver confl ictos entre normas constitucionales que disponen derechos fundamentales sin necesidad de ponderar? Para ello expondremos la teoría que, para los casos de confl ictos constitucionales de derechos, propone reconstruir sistemas normativos. Esta teoría está representada en los trabajos de Moreso, Mendonca y Martínez Zorrilla y se presenta como una alternativa a la ponderación. Concluiremos que, si bien esta teoría puede resultar un buen complemento a la hora de formalizar las (...) decisiones judiciales sobre asuntos constitucionales, no puede reemplazar de plano a la ponderación, pues ésta siempre subyacería latente. Ello puede vislumbrarse con claridad en los casos donde derechos sociales fundamentales pretenden validez, en cuyo contexto la ponderación se presenta como algo conceptualmente necesario. (shrink)

El objetivo de este artículo es hacer una reconstrucción racional del uso del examen de proporcionalidad en contextos de adjudicación judicial de derechos sociales constitucionales. Dicho trabajo de reconstrucción será desarrollado en dos pasos. En primer lugar, se tratará el interrogante referido a si el examen de proporcionalidad en su variante “por omisión” exhibe o no una estructura diferente con respecto a su, mucho más conocida e investigada, variante “por exceso”. En segundo lugar, se describirán las reglas y formas de (...) argumentación que están implícitas en el uso del examen de proporcionalidad por omisión y que componen a sus respectivos sub-exámenes de idoneidad, necesidad y proporcionalidad stricto sensu. Ahora que tan familiarizados andamos con el término crisis, suele olvidarse que hace ya bastantes años, y desde presupuestos ecológicos, veníamos hablando de otra crisis, la ambiental, si bien la experiencia ha demostrado que no estaban tan lejanas, ni en el tiempo, ni en el origen: el medio ambiente y sus alteraciones no son sino un formidable indicador del modelo económico que subyace.

En este artículo, analizamos el significado de las matrices densidad en el formalismo de la mecánica cuántica. Discutimos el problema de los "sistemas cuánticos compuestos" en la lógica cuántica así como también la interpretación de las mezclas impropias. Tomando en cuenta el desarrollo de la lógica cuántica convexa, presentamos un análisis de la estructura formal de la teoría que, argumentaremos, debe ser considerado a la hora de desarrollar un nuevo esquema conceptual para la interpretación de las mezclas cuánticas. In this (...) article, we analyze the meaning of density matrices within the formalism of quantum mechanics. We discuss the problem of compound systems in the context of quantum logic as well as the interpretation of improper mixtures. Taking into account the development of convex quantum logic, we present an analysis of the formal structure of the theory which we will argue, must be taken into account when developing a new conceptual scheme for the interpretation of quantum mixtures. The Kochen-Specker theorem is one of the fundamental no-go theorems in quantum theory. It has far-reaching consequences for all attempts trying to give an interpretation of the quantum formalism. In this work, we examine the hypotheses that, at the ontological level, lead to the Kochen-Specker contradiction. We emphasize the role of the assumptions about identity and distinguishability of quantum objects in the argument.

Quantum indistinguishability directly relates to the philosophical debate on the notions of identity and individuality. They are crucial for our understanding of multipartite quantum systems. Furthermore, the correct interpretation of this feature of quantum theory has implications that transcend fundamental science and philosophy, given that quantum indistinguishability is a resource in quantum information theory. Most of the conceptual analysis of quantum indistinguishability is restricted to studying the permutational invariance of quantum states, the concomitant quantum statistics and their entanglement. Here, we (...) analyse the role of indistinguishability and non-individuality in other areas of quantum theory. We start by analysing how a very peculiar use of indistinguishability underlies Feynman’s rules for summing amplitudes in interference phenomena. Next, we study how quantum indistinguishability is underestimated in several topics of debate in the quantum physics literature, such as the Einstein–Podolsky–Rosen argument, Bell’s inequalities and the Bell–Kochen–Specker theorem. Finally, we argue that an ontology of truly indistinguishable entities can serve as a basis for a quantum ontology that can give interesting answers to the interpretational problems of quantum mechanics. We claim that, in addition to superposition, contextuality and entanglement, indistinguishability (understood in a robust ontological sense) is one of the central features of quantum physics. -/- . This paper describes two contemporary houses and their respective gardens: the small post-earthquake temporary shelters in Onna, Italy and Derek Jarman’s Prospect Cottage in Southern England. To dwell, as per the Heideggerian perspective, is an act of cultivation of the soil, the transformation of wilderness into a tilled (architectural) garden: it entails rootedness, permanence, and recurring practices of care. Nevertheless, what these two architectural gardens show is that in our time, while caring for the land can still epitomize the subjugation (...) of chthonic forces, attempting to institute an ecological relation of domination, it may also point in an altogether different direction. In Onna, the gardens appear as an act of resistance against the menacing forces of wilderness; Jarman’s attitude is that of a pathic acceptation of the atmospheric powers pervading the vast marine environment. Objective of the study: To analyze the costs and profits of sugarcane production regarding the cultural practices of sugarcane suppliers. Methodology/approach: This study positions itself in this gap by comparatively analyzing 6 types of cultural practices: unraveling, windrowing, application of correctives, herbicides, insecticides and fertilizers, with the option of two systems Fixed rate (TF) and Variable rate (TV). Originality/Relevance: Brazil is a world reference in sugarcane production, with the State of São Paulo being the largest Brazilian producer. However, for sugarcane (...) suppliers to maintain this activity there is a need to reduce production costs and increase profitability/ha. However, there is a theoretical-practical gap in the financial assessment (costs and profits) of different cultural practices inherent to sugarcane production. Main results: The results demonstrated that the costs of cultural practices represent more than 30% of the total sugarcane production costs. The TF system proved to be more cost-efficient in the following operations: correctives, herbicides and insecticides. In the application of fertilizers, the TV system, in broadcast mode, had the best result. Finally, the profit/ton was R$1.70, demonstrating a very low profit margin/ha given the risk of the activity. Theoretical/methodological contributions: The sample for this research comprised 55 sugarcane suppliers from the State of São Paulo, whose data were obtained through a survey. The comparative analysis was based on the difference in costs of cultural practices and the estimation of the level of certainty (profit/costs), analyzed through the cumulative frequency carried out through the Monte Carlo Simulation (SMC). It is well known that in quantum mechanics we cannot always define consistently properties that are context independent. Many approaches exist to describe contextual properties, such as Contextuality by Default, sheaf theory, topos theory, and non-standard or signed probabilities. In this paper we propose a treatment of contextual properties that is specific to quantum mechanics, as it relies on the relationship between contextuality and indistinguishability. In particular, we propose that if we assume the ontological thesis that quantum particles or properties (...) can be indistinguishable yet different, no contradiction arising from a Kochen-Specker-type argument appears: when we repeat an experiment, we are in reality performing an experiment measuring a property that is indistinguishable from the first, but not the same. We will discuss how the consequences of this move may help us understand quantum contextuality. (shrink)

Research on bodies and work relies on theoretical perspectives that see the working body as a resource and/or symbol. This study bridges these complementary theories, incorporating two concepts that extend and synthesize them into a more holistic model of embodied inequality. Drawing primarily on the accounts of women domestic workers in Ecuador’s largest city, I explore the embodied dimensions of domestic work and show how unequal relations between workers and employers manifest in and on bodies, specifically through interactions around health, (...) food, and appearance/clothing. I argue that paid domestic workers’ bodies are simultaneously resources that can be used for work, and symbols interpreted according to local hierarchies of gender and class. (shrink)

This article defends the centrality of practical wisdom in medical practice by building on a monistic view of moral virtue, termed the “Aretai model,” according to which possession of practical wisdom is necessary and sufficient for virtuousness, grounding both moral growth and effective moral behavior. From this perspective, we argue that practical wisdom should be conceived as a cross-situational ethical expertise consisting of four skills:moral perception, moral deliberation, emotion regulation, and moral motivation. Conceiving of practical wisdom as both overall virtuousness (...) and ethical expertise makes it possible to deal adequately with the uniqueness of concrete ethically relevant situations. We contend that this becomes particularly evident in the context of medical practice, both in terms of decision-making and action-taking, especially in the most challenging or contentious clinical cases. We conclude the article by suggesting the potential implications of the Aretai model for continuing education in medical and healthcare professions. (shrink)

Kit Fine’s contribution to logic is vast and diverse; the chapters in this book deal with a significant part of it. In this introductory chapter, we clarify and contextualize the main themes of Fine’s work that are centre stage in this book, after which we give a summary of each chapter.

SPECIAL SECTION: BUILDING UNIVERSES: THE PHILOSOPHICAL AND MATHEMATICAL UNDERPINNINGS OF COSMOLOGY (EIGHTEENTH–TWENTIETH CENTURIES) .

The purpose of this article is to make a rational reconstruction of the use of the proportionality test in contexts of judicial adjudication of constitutional social rights. This reconstruction will be developed in two stages. Firstly, I will deal with the question of whether the proportionality test in its variation by omission (that is, in cases of positive rights) exhibits or not a different structure with respect to its (better known and developed) variation by excess (that is, in cases of (...) negative rights). Secondly, I will describe the rules and forms of argumentation implied in the use of the proportionality test by omission, which constitute its respective sub-tests of suitability, necessity and proportionality stricto sensu. Non-well-founded trees are used in mathematics and computer science, for modelling non-well-founded sets, as well as non-terminating processes or infinite data structures. Categorically, they arise as final coalgebras for polynomial endofunctors, which we call M-types. We derive existence results for M-types in locally cartesian closed pretoposes with a natural numbers object, using their internal logic. These are then used to prove stability of such categories with M-types under various topos-theoretic constructions; namely, slicing, formation of coalgebras , and sheaves for an (...) internal site. The costs of agricultural inputs added to those of labor represent almost a third of the total cost of Brazilian sugarcane production. This study analyzes the behavior of the price per ton of sugarcane in Brazil, relating it to the main production costs of this cultivation. Twelve price indicators from January 2015 to December 2020 were evaluated. First, the data were adjusted to a multiple linear regression model to identify the significant variables on variation in the price per ton of (...) sugarcane. Then, the Monte Carlo simulation was used to measure the level of certainty of occurrence of these variables, and forecasts were obtained from the adjustment of ARIMA models. The results showed the influence of the costs of diesel oil, two agricultural pesticides, and daily laborers on the price of sugarcane, besides an increasing trend of its, providing relevant short-term projections for decision-making about investments in the agribusiness sector. In this work, we discuss a formal way of dealing with the properties of contextual systems. Our approach is to assume that properties describing the same physical quantity, but belonging to different measurement contexts, are indistinguishable in a strong sense. To construct the formal theoretical structure, we develop a description using quasi-set theory, which is a set-theoretical framework built to describe collections of elements that violate Leibnitz's principle of identity of indiscernibles. This framework allows us to consider a new ontology (...) in order to study the properties of quantum systems. (shrink)

Resumen El artículo expone la noción de temporalidad discontinua implícita formalmente en la fenomenología de la conciencia interna del tiempo de Husserl y las correspondencias equivalentes que se encuentran en una lectura atenta de la obra de Marcel Proust. Para eso se reconstruye la peculiar noción de tiempo implícita en la obra de ambos autores mostrando el sentido diferencial y discontinuo que la misma reviste. A partir de dicha reconstrucción se desarrollan las implicaciones críticas que la misma acarrea respecto de (...) las concepciones tradicionales de memoria, subjetividad y corporalidad. Finalmente se hacen algunas consideraciones respecto de las influencias recíprocas entre filosofía y arte.The article exposes the notion of a discontinuous temporality formally implied in Husserl's phenomenology of internal time consciousness and its corresponding equivalencies found in an attentive reading of the work of Marcel Proust. To this end, the peculiar notion of time implicit in the work of both authors is reconstructed showing the differential and discontinuous sense that this notion has. It is developed the critical implications that this reconstruction carries with it regarding the traditional conceptions of memory, subjectivity and corporeality. Finally, some considerations are made regarding the reciprocal influences between philosophy and art. (shrink)
